02-330    The meeting was called to order at 8:05 p.m. by Council Chair Daniel S. Paletko.

 

Roll Call showed the following:

02-334    Motion by Councilwoman Agius, seconded by Councilwoman Horvath, that the City Council concurs with and approves the Resolution directing Act 345 Police and Fire Pension Board to provide a Retiree Supplemental Benefit Program for current eligible police patrol officers, police supervisors and firefighter retirees, per Mayor Canfield, communication dated August 7, 2002.  Further, that the Mayor and City Clerk be authorized to sign the resolution on behalf of the City.

02-335    Motion by Councilman Baron, seconded by Councilman Constan, that the City Council concurs with and approves the Ecorse Creek Subwatershed Grant Agreement between Wayne County and Dearborn Heights for the Ecorse Creek Subwatershed Commercial Illicit Connection Inspection Program (IDEP), per Mayor Canfield, communication dated August 7, 2002.  Further, that the Mayor and City Clerk be authorized to sign the Agreement on behalf of the City.

02-336    Motion by Councilman Constan, seconded by Councilwoman Badalow, that the City Council concurs with and approves Quest Energy, LLC to purchase and install telephone splitters, at a cost of $150.00 per location, (approximately $1,650.00), needed for the Electric Choice Agreement between the City and Kimball Power Company, LLC, per Mayor Canfield, communication dated August 7, 2002.  Further, that the Mayor be authorized to sign the Execution of Authorization Letter.

 

02-337    Motion by Councilman Constan, seconded by Councilwoman Badalow, that Comptroller Donald Barrow be appointed the new Member Representative for the Electric Choice Program replacing Kurt Heise.

02-338    Motion by Councilwoman Van Houten, seconded by Councilwoman Agius, that the City Council concurs with and approves the route for the St. Linus Festival Bike and Blade Parade, scheduled for Friday, September 6, 2002 commencing at St. Linus parking lot onto Hass proceeding west toward Evangeline, proceeding north to Richardson then east on Richardson to Gulley proceeding south on Gulley back to St. Linus parking lot, per Mayor Canfield, communication dated August 7, 2002.  Further, that the Police and Fire Departments to provide escort and assistance as requested.

02-339    Motion by Councilwoman Horvath, seconded by Councilwoman Van Houten, that the communication from Mayor Canfield, dated August 7, 2002 re: Reappointments of Richard Buckholz, William Eby and Martin O=Sullivan to the Recreation Commission, terms to expire September 2005, be received, contents noted and filed.

02-340    Motion by Councilwoman Horvath, seconded by Councilwoman Van Houten, that the communication from Mayor Canfield, dated August 7, 2002 re: Reappointment of Peter Zachary to the Cable TV Regulatory Commission, term to expire August 2005, be received, contents noted and filed.

02-341    Motion by Councilwoman Horvath, seconded by Councilwoman Van Houten, that the communication from Mayor Canfield, dated August 7, 2002 re: Reappointment of Fran Robinson to the Housing Commission, term to expire July, 2007, be received, contents noted and filed.

02-342    Motion by Councilwoman Horvath, seconded by Councilwoman Agius, that the City Council concurs with and approves the reappointment of Richard Coogan, Marie Derry and Jumana Judeh, to the Planning Commission, terms to expire May 2005, per Mayor Canfield, communication dated August 7, 2002.

02-343    Motion by Councilwoman Horvath, seconded by Councilwoman Agius, that the City Council concurs with and approves the reappointment of Joseph Connor to the Local Officers Compensation Commission, term to expire July, 2009, per Mayor Canfield, communication dated July 31, 2002.

02-344    Motion by Councilwoman Horvath, seconded by Councilwoman Agius, that the City Council concurs with and approves the reappointment of Michael Sarb to the Demolition Board of Appeals, term to expire July, 2005, per Mayor Canfield, communication dated August 7, 2002.

02-345    Motion by Councilman Baron, seconded by Councilwoman Badalow, that a Public Hearing be scheduled on Tuesday, September 24, 2002, at 8:00 p.m. for the purpose of discussing the Agency Plan, per Housing Commission Director Oliverio, communication dated August 1, 2002.

02-346    Motion by Councilwoman Badalow, seconded by Councilwoman Van Houten, that the City Council concurs with and approves an Indemnification Agreement Transferring Ownership of Swapka/Powers Park Bleachers to D7 School District, two (2) sections and the remaining three (3) sections to Crestwood Little League, per Recreation Director Grybel, communication dated August 6, 2002.

02-347    Motion by Councilman Baron, seconded by Councilwoman Badalow, that the quotation from Barrett Paving Materials, Inc., 5800 Cherry Hill Road, Ypsilanti, MI 48198 for Cold Patch material for the 2002-2003 season, specifically, CP-5 Pave 192, in the amount of $41.00 per ton, be approved per, Public Service Administrator Blackburn, communication dated July 30, 2002.

02-348    Motion by Councilwoman Van Houten, seconded by Councilman Constan, that the request from Deputy Fire Chief McElroy, dated August 6, 2002 to dispose of one (1) Gestetner Copier Model 5230, tag #05221 and one (1) IBM monitor, tag 07447, be approved.

02-349    Motion by Councilwoman Van Houten, seconded by Councilman Baron, that the communication from Recreation Director Grybel, dated July 16, 2002 Re: Swapka/Powers Park Pavilion Project Contractor Contract Approval Request, be referred back to Administration.

02-350    Motion by Councilwoman Van Houten, seconded by Councilman Baron, that proposed Ordinance H-02-22, AN ORDINANCE OF THE CODE OF ORDINANCES, CITY OF DEARBORN HEIGHTS, BE AMENDED BY AMENDING SECTION 20-56 OF SAID CODE, REGARDING DOMESTIC ASSAULT AND BATTERY, be considered read for the second time to become effective upon publication in the City=s official newspaper.

 

Motion unanimously adopted.

 

02-351    Motion by Councilwoman Agius, seconded by Councilwoman Badalow, that proposed Ordinance H-02-23, AN ORDINANCE OF THE CITY OF DEARBORN HEIGHTS, PROVIDING THAT THE CODE OF ORDINANCES, CITY OF DEARBORN HEIGHTS, BE AMENDED BY ADDING SECTION 14-49 OF SAID CODE REGARDING COST RECOVERY FOR UTILITY LINE FAILURES, ARSON TYPE FIRES, AND FIRE SUPPRESSION INCIDENTS, be considered read for the first time.

02-352    Motion by Councilwoman Agius, seconded by Councilwoman Badalow, that proposed Ordinance H-02-24, AN ORDINANCE OF THE CITY OF DEARBORN HEIGHTS, PROVIDING THAT THE CODE OF ORDINANCES, CITY OF DEARBORN HEIGHTS, BE AMENDED BY ADDING ARTICLE VIII, SECTIONS 6-161, 6-162, 6-163, 6-164, 6-165 AND 6-166 TO CHAPTER 6 OF SAID CODE REGARDING SPECIAL REGULATIONS PERTAINING TO DANGEROUS OR VICIOUS DOGS, be considered read for the first time.

02-353    Motion by Councilwoman Agius, seconded by Councilwoman Badalow, that proposed Ordinance H-02-25, AN ORDINANCE OF THE CITY OF DEARBORN HEIGHTS, PROVIDING THAT THE CODE OF ORDINANCES, CITY OF DEARBORN HEIGHTS, BE AMENDED BY ADDING SECTION 20-38 OF SAID CODE REGARDING NUISANCES CREATED BY ALARMS AND REGISTRATION OF ALARMS, be considered read for the first time.

02-354    Motion by Councilwoman Badalow, seconded by Councilman Baron, that Permanent Traffic Control Device Request T-136, "Stop" signs for the northwest and southeast corners of McKinley and Lehigh, be approved.
